It is not illegal but insurance may be an issue.

I believe you are right it was rated for 175 hp check the plate if it is still there any thing over the rated HP will void your insurance if you have a problem

It would be illegal in a tournament if there are rules that state enforcement on max ratings .
Also fyi, USCG rules for manufacturers allow 10% in excess HP rating on new boats.
