Just for my education.

If you purchase a gun from an individual, are you required to register this firearm somewhere? If you sell a gun, are you required to register the sale somewhere? Can you legally sell a gun to an individual that does not have a carry permit?
 
NO. NO and YES

You can buy a gun privately from another individual without registering the gun, however you take a chance that you are buying a stolen firearm. You also can sell a gun without doing any paperwork, but the gun remains registered to you then and if you sell to someone and they go out and commit a crime, the weapon will be traced back to you. You can sell to a person without a carry permit, but that person could very well be a convicted felon or mental case.

When you fill out a form 4473, that stays in the possession of the dealer, it DOES NOT get forwarded in any way to the federal or local GVT. The government doesnt know what you have, until they pass a law requiring registration, they can only track possession of a gun through legal channels. The ATF starts at the manufacturer, and then to the distributor or dealer they shipped it to, then they dig through the file at the dealer for your 4473, and then come asking how your gun ended up in the Kangaroo after a shooting. Either you did it and dropped it, or you sold it, or it was stolen by a scumbag who used it for such purposes.

The only "registration" of any gun is a class 3 weapon, which includes short-barrels rifles and shotguns, or "SBR's", silencers, or guns equpied with one, and FULL automatics, not to be confused with semi-autos.</p>
 
Also remember passing firearms over statelines requires a FFL transfer. Something to be noted on here since there are a lot of us in GA.

What about a 3310.4?
 
I always make someone sign a bill of sale with Drivers liscense number on it if I am selling a gun to an individual. I also make someone sign something with DL number on it if Im buying one also that way if it is stolen or has been used in a crime I have a record of when and where I got it. If someone isnt willing to sign a piece of paper dont do business with them.

That is an excellentpractice... Even though it is not required, it could come in very handy in certain situations.</p>

actually there is a FEDERAL LAW against a national gun registration. It's part of the checks and balances. But if we don't speak out there may be a bunch of laws that only breach our 2nd Amendment rights. It's proven the Assault Weapons ban, the high cap ban, etc. doesn't work. And what are they gonna do, there are a TON of mags that were sold when the ban lifted before marked "for law enforcement use only."

WE ALL NEED TO LET OUR LEADERS KNOW THAT BANNING GUNS DOES NOT DO ANYTHING EXCEPT KEEP GUNS OUT OF PROPERLY TRAINED CITIZENS HANDS AND IN THE HANDS OF CRIMINALS.. You should, if you are able, get your permit and learn to use your firearm. If everyone is armed or thought to be, it would be a better society.

GUNMEN CHOOSE SCHOOLS, MALLS BECAUSE THERE IS NO ONE THERE TO OPPOSE THEM. WHEN WAS THE LAST TIME SOMEONE ROBBED A LIQUOR STORE? THEY DON'T BECAUSE THEY ARE PREPARED. KENNESAW, GA..... IS THE BEST, BEST EXAMPLE there the Head of Household is required to maintain a firearm and they have the lowest crime rate!!

JUST DON'T BE A SHEEP..... SPEAK OUT TO YOUR LEADERS.. PRESIDENT AND EVERYONE BELOW HIM......

The second Amendment to the Constitutuion of the United States of America has been put in place to allow individual citizans to defend themselves against all enemies, both foreign and domestic. Our forefathers had the foresight to include this is our Bill of Rights so that we can protect ourselves against intruders or against a government that has gone wrong...
I'm not spouting anything unpatriotic,
Howerever our forefathers sought to allow us to protect ourselves against an obstusive government that might want to remove our rights..

When you discontinue your dealer's license, you must give all the 4473's to the BATFE. I had to do this when I gave up my FFL as instructed by the local BATFE office. The national gun registration isn't in effect like many other countries where you have to record andy sale or transfer of a firearm. Of course, you don't need anyone's permission to steal a firearm.

Q: What record-keeping procedures should be followed when two private individuals want to engage in a firearms transaction?
When a transaction takes place between private (unlicensed) persons who reside in the same State, the Gun Control Act (GCA) does not require any record keeping. A private person may sell a firearm to another private individual in his or her State of residence and, similarly, a private individual may buy a firearm from another private person who resides in the same State. It is not necessary under Federal law for a Federal firearms licensee (FFL) to assist in the sale or transfer when the buyer and seller are “same-State” residents. Of course, the transferor/seller may not knowingly transfer a firearm to someone who falls within any of the categories of prohibited persons contained in the GCA. See 18 U.S.C. §§ 922(g) and (n). However, as stated above, there are no GCA-required records to be completed by either party to the transfer.

There may be State or local laws or regulations that govern this type of transaction. Contact State Police units or the office of your State Attorney General for information on any such requirements

Please note that if a private person wants to obtain a firearm from a private person who resides in another State, the firearm will have to be shipped to an FFL in the buyer’s State. The FFL will be responsible for record keeping. See also Question B3.
