one of my favorite ponds was destroyed they took a track ho and opend the dam and released all the water and fish into a hollow,does the DNR not have any say in how this should have been done?

I don't know about the legalities of breaching the dam and releasing the water and DNR or state jurisdicition. But, I do know that impounding water inherently creates a legal liability. Many, many dams are poorly maintained. Think about how much water from even a small pond can run down the watershed with a catastropic dam failure. Eight pounds per gallon of water times a million gallons equals a bunch of potential energy. Sometimes it's best to breach the dam and properly repair the it and the outlet works. Is that the case here or are they just getting out of the pond business? It appears to be a beautiful site.
 
It might be necessary to repair the dam, but I know in most states the DNR/Wildlife guys are usually there with a barrell to pick up fish and relocate them. Still really sucks that one of your fav ponds is gone. I grew up fishing many of them....
 
If it is a private pond and draining it would cause no damage to others' property I can't see where it would be any of the DNR's business.
