I was parked at a red light and some lady smashed into my brand new 2016 ram 2500 4x4 cummins truck. The truck had less than 1000 miles on it and the insurance are telling me all they are going to do is pay for the damages and a cheap rental car.... I'm told there is Nothing I can do about the loss of value or trouble it's caused me... No bass fishing for a while I guess...anybody know what I can do???? This doesn't seem fair... They won't even pay for a rental truck so I can pull my bass boat around, which is the main reason I bought it for. I just paid 60k for it.
 
OOCH!!!!!!! So sorry, that really sucks. Nothing you can do, it is all about how your policy is written and what kind of insurance she has. :( jmax
 
That sux a big one. I do know how you feel except the lady hit my new boat before it hit my new truck. I was lucky and had boat replacement insurance so I did get my new boat replaced. Not so lucky on the truck.
 
Sounds like it's time to change insurance companies once the dust settles. I use Allstate and wrecked my pickup back in August. They were great. I'll probably be an Allstate customer for life.
 
Oh, you're dealing with her insurance..?? I'd go talk to an attorney.. Allstate is still really good in my opinion..

You should recover some of your loss of value. I am an agent in Georgia and we have a provision to pay diminished value due to damage from an accident. While it is not a windfall it does help recover some of the loss you incur from your damage in an accident. As far as a rental all the other company is required to provide is transportation unless it is a vehicle used to provide income. How much damage do you have? If it is drivable I would suggest driving it until it has to be put in the shop for repair.
 
I was told by an insurance agent that it was a law they had to pay depreciation but not unless you ask. This was in Georgia.
 
I was told to demand loss of depreciation since it wasn't your fault was told to not settle until they agree because the car lot will ding you if you trade. I was told this by sales manager at marshall mize.
 
I totally agree with the depreciation. My son bought a Hyundai. A week after he bought it, a girl backed into it while it was parked. Around $500.00 damage. He is now trading it. That little $500.00 damage has knocked $3000.00 off of his trade in.
 
You can recover the difference for loss of value if the other is a fault, but like above said, you will need a lawyer to splain that to her insurance. He / she will get 30-40%
